A Federação Nacional dos Jornalistas (FENAJ) assumiu papel central na luta contra a pejotização no Tribunal Superior do Trabalho (TST), ao se manifestar como amicus curiae em um processo que pode definir os rumos da contratação de trabalhadores por meio de pessoa jurídica no Brasil. A entidade, ao lado dos Sindicato de Jornalistas da Bahia (Sinjorba) e de São Paulo (SJSP), defende que a prática, amplamente disseminada nas redações do país, constitui fraude trabalhista e deve ser considerada inválida sempre que forem constatados os requisitos legais da relação de emprego.
O caso que deu origem ao debate envolve um trabalhador de Vila Velha (ES), que foi empregado da Imetame Energia Ltda. e, após constituir uma empresa individual, continuou a exercer as mesmas funções, mas como prestador de serviços. A ação movida por ele busca o reconhecimento do vínculo empregatício com base no princípio da primazia da realidade.
Na manifestação protocolada no TST, FENAJ os Sindicatos argumentam que a pejotização tem sido usada de forma indiscriminada para mascarar vínculos formais de emprego, resultando na supressão de direitos básicos como férias, 13º salário, FGTS e proteção previdenciária. “Hoje, é comum encontrarmos redações completamente pejotizadas, onde trabalhadores exercem suas funções sob subordinação, com jornada fixa e pessoalidade, características típicas de um vínculo regido pela Consolidação das Leis do Trabalho (CLT)”, afirma o advogado Raphael Maia, que representa a Federação e o SJSP no processo.
A petição destaca que a pejotização não deve ser confundida com a terceirização lícita reconhecida pelo Supremo Tribunal Federal. Enquanto a terceirização envolve uma empresa intermediária, a pejotização consiste na imposição direta para que o trabalhador constitua uma pessoa jurídica, “dissimulando uma relação que, na essência, é de emprego”.
Além dos prejuízos individuais aos jornalistas, a prática causa impacto estrutural à sociedade. As entidades alertam para a queda na arrecadação previdenciária e fiscal, o aumento da judicialização e o risco de descrédito da Justiça do Trabalho. “Autorizar a pejotização indiscriminada seria desvalorizar as decisões das instâncias ordinárias da Justiça do Trabalho, construídas com base em provas concretas e instrução regular”, sustenta a FENAJ.
A Federação também chama atenção para a repercussão social do julgamento, que pode abrir precedente para legitimar a precarização das relações de trabalho em diversas categorias profissionais. “A tese que propomos é clara: é inválida a contratação de pessoa jurídica para função tipicamente exercida por empregados, quando presentes os requisitos do vínculo empregatício previstos nos artigos 2º e 3º da CLT”, defendem FENAJ e SJSP.
Ao atuar como amicus curiae, a FENAJ reafirma sua histórica missão de defender a dignidade profissional dos jornalistas e combater práticas que ferem direitos conquistados ao longo de décadas de luta sindical. “Não se trata de um interesse corporativo, mas da proteção do jornalismo enquanto função social essencial à democracia”, conclui a petição.
Diálogo no STF
Em fevereiro deste ano, direrores da FENAJ se reuniram com o ministro Flávio Dino, da Primeira Turma do Supremo Tribunal Federal (STF), acompanhados do deputado federal Daniel Almeida (PCdoB/BA), para discutir os impactos da contratação irregular de jornalistas como pessoas jurídicas.
Durante o encontro, a FENAJ reforçou que a contratação de jornalistas como empresas individuais não pode ser usada para ocultar vínculos empregatícios reais. A entidade buscou sensibilizar o ministro sobre a realidade da categoria, marcada por precarização extrema, e pediu atenção às decisões do STF que podem afetar diretamente os direitos trabalhistas dos jornalistas.
Flávio Dino demonstrou preocupação com a pejotização, classificando-a como potencialmente fraudulenta quando utilizada para mascarar relações subordinadas. Screen-reader optimization: we run a background process that learns the website’s components from top to bottom, to ensure ongoing compliance even when updating the website.
In this process, we provide screen-readers with meaningful data using the ARIA set of attributes. For example, we provide accurate form labels;

Audio muting – users with hearing devices may experience headaches or other issues due to automatic audio playing. This option lets users mute the entire website instantly.
Cognitive disorders – we utilize a search engine that is linked to Wikipedia and Wiktionary, allowing people with cognitive disorders to decipher meanings of phrases, initials, slang, and others.
Additional functions – we provide users the option to change cursor color and size, use a printing mode, enable a virtual keyboard, and many other functions.

We aim to support the widest array of browsers and assistive technologies as possible, so our users can choose the best fitting tools for them, with as few limitations as possible. Therefore, we have worked very hard to be able to support all major systems that comprise over 95% of the user market share including Google Chrome, Mozilla Firefox, Apple Safari, Opera and Microsoft Edge, JAWS and NVDA (screen readers).
